A product can have a polished label, a signed purchase order and a booked shipment—and still be unready for the US market. Registration and listing are not approval.
A cosmetic product can have a polished label, a signed purchase order and a booked shipment—and still be unprepared for the US market.
One recurring source of confusion is the difference between facility registration, product listing and product approval. These are not interchangeable. For Indian beauty brands, exporters and private-label buyers, understanding that distinction early can prevent avoidable delays, misleading supplier claims and last-minute document requests.
The US Food and Drug Administration (FDA) updated its cosmetics registration and listing information in September 2026 to clarify that it does not issue certificates or other documents verifying compliance with cosmetic facility registration or product listing. FDA registration and listing are not an approval programme and should not be used as a promotional claim.

For an export project, the practical question is not simply, “Is the factory registered?” It is: “Who owns each regulatory obligation, what evidence supports the product’s safety and label, and can the complete dossier be produced when the importer or regulator needs it?”
Why documentation ownership matters
An export project works best when the brand owner, importer and contract manufacturer agree who owns each record, who approves artwork, and who can retrieve the current product dossier. Set these responsibilities before the purchase order is confirmed, not after the shipment is packed.
Why the distinction matters to exporters
MoCRA, the Modernization of Cosmetics Regulation Act of 2022, established requirements that include facility registration, product listing, safety substantiation and serious adverse-event reporting. Specific exemptions apply, so assess the actual facility, product and responsible person rather than assuming every requirement applies universally.
FDA reported 16,398 active cosmetic facility registrations and 1,298,361 active cosmetic product listings as of June 30, 2026. These figures show the scale of the system; they do not mean those facilities or products are FDA-approved. A registration number is not a substitute for a finished-product safety file, compliant label, ingredient review or agreed responsibility between the brand owner, US responsible person, importer and contract manufacturer.
